I am planning on starting an email service with a couple of friends that offers privacy in very much the same way that cryptostorm does, with very similar ToS. If it works out we are also planning on expanding to webhosting aswell, again with the same aims for privacy for users. I was wondering what measures cryptostorm (and anyone else willing to contribute) take to deal with copyright and DMCA and other legal issues if they go any further than a nasty letter. This also goes for any trouble with the law aswell (as in police).
Any suggestions and advice, from anyone, for someone new in this area would be great, thanks.

Although I can't offer any help in dealing with the technical side of your idea, I can tell you how to communicate with the police for your benefit and not theirs:-

Assuming you find the right DC that doesn't ask you for your ID, that has ToS that doesn't just terminate your account after the first stupid letter, them you should:
- Create a fake company for this project
- Create fake online identities for the owner of this fake company
- Get staff that knows how to answer fast to DDOS
- Never contract an exterior company to help you out
- Get a DC that allows you to directly get your DCMA, complains & others to you and not getting them transferred to you, this way the DC will never know until the last stage
- Always respond to any letter properly formatted, just ignore the DCMA spam bots, there are a couple of sites that show you examples on how to do it
- Always do has Lavabit and CS, tell yours customers the truth, if you get some kind of law enforced document to provide info about someone just close down the server
- Most important, KEEP NO LOGS WHATSOEVER, IF YOU KEEP NO LOGS THERE ARE NOTHING TO HAND OVER TO LAW ENFORCEMENT!
